do you think the whale population is the only ones effected by the Superferry?

Is this environmental protection, or environmental extremism?

Great question... or is there a better one?

A growing number of people who initially supported the Superferry are asking for the EIS (Environmental Impact Study) and for the Superferry an our representatives to well... following the law.

They would say this is NOT about the environment, but something more.

I realize this is not what you might be hearing about in the news. You may ask yourself why this can be.
Let's try an image how some folks might be seeing this issue.
Think of this example
You live in a very nice home with a guard at the gate.
One day someone enters your home, trashes the place.
When you ask the guard what happened they side with the vandal.
you read the local newspaper and the story reads "Home owner attacks peaceful visitor"
Then..
you go to court
the judge says "yes, the vandal trespassed and needs to get your approval before returning to the house"
great. no problem.
the next day, the vandal returns and continues trashing your home while the guard (your hired guard) defends them, maybe even holding you down.

Is this justice? Is this the way, we have decided,it is acceptable live our lives?

You may decide. I believe the people who have the money and influence should be able to do what they please, when they please. The rights of the many (people) are less then the wants of a few.
And...
all you need to do is get more money and influence..

It that a balanced approach?

So, Is this environmental protection, or environmental extremism?

On August 23, 2007, (Hawaii) State Supreme Court unanimously ruled that the State and Superferry are in violation of the Hawaii Environmental Protection Act. The court ruled that the Hawaii Department of Transportation and Superferry must complete an environmental review of their operations if they wish to operate in Hawaii's waters.

Then why are they resuming service? Oct. 1st.
Why did the governor and her entire office reject the initial 6,000 signatures properly presented or the newspapers NOT write about the now 10,000 signatures requesting an EIS first. (these signatures where presented the last 3 minutes of the Linda Lingle visit to Kaua'i (see http : // govsvr1. hawaii. gov /govvideo). sorry about spaces.

This is NOT about only the environment. This is about money and power pushing there way around. It IS about government representatives NOT representing the people, but interests of... well these folks. (listed below the Federal Litigation)

Kaua'i wants the Superferry to FOLLOW THE LAW.

To update everyone on the developments related to the suit in Federal Court challenging the Coast Guard Superferry Security Zone Rule:

1. The cancellation of the Superferry trip to Kaua'i on September 26 removed the emergency that caused me to file the Motion for a Temporary Restraining Order.

2. Today (Monday), I returned from Kaua'i to Honolulu. I went to the Court and filed the following: a. A notice of withdrawal of the Motion for a Temporary Restraining Order. b. A motion to amend the existing Complaint and a revised Complaint. The amendments were both technical and substantive. The technical amendments corrected some errors in the Complaint. The substantive amendments (1) added one new Plaintiff -- Hope Kallai. Hope has filed a petition requesting the Maritime Commission revoke the loan guarantees made for Superferry. [see (3) below]. (2) added three new Defendants ˆ Mary E. Peters, Secretary of the U.S. Department of Transportation; Sean Connaughton, Administrator, U.S. Maritime Commission; and Hawaii Superferry, Inc. (3) added five new counts (a). Alleged a violation of law by the Maritime Commission continuing to leave the loan guarantees in place for Superferry. The argument for that violation is that the Maritime Commission conditioned the loan guarantees on the State of Hawaii not requiring any further environmental work. The Supreme Court ruling means that the State of Hawaii is now compelled to prepare an environmental assessment. The State certification to the Maritime Commission that all environmental work was complete is, therefore, void. Because that certification is a legally required condition of such guarantees, the guarantees are also now void. (b). Alleged the Maritime Commission had acted outside its authority (ultra vires) by requiring the State of Hawaii not to prepare an EIS as a condition on Superferry's loan guarantees. The Maritime Commission has no authority to compel a state to ignore state laws. (There are different versions of what happened here (see below). The continuing litigation offers an opportunity to get the truth into the light.) (c). Alleged that the activation of the security zone would violate traditional Hawaiian gathering rights. (d). Alleged that the Defendants have inflicted and continue to inflict emotional distress on the Plaintiffs. (e). Alleged that the Defendants have violated the State Constitution provision guaranteeing to all citizens "a clean and healthful environment, as defined by laws relating to environmental quality." (f). Alleged that the Coast Guard is planning to illegally seize a public harbor and public lands with the intent of excluding all members of the public, except for those the Coast Guard decides can enter. c. A group of exhibits including the statements I got from Plaintiffs during my trip to Kaua'i. (For those I did not get to see, we can do this now by email and snail mail.) d. Another exhibit containing the petition filed by Hope Kallai seeking revocation of the loan guarantees.
