Where did you get that idea? I remember when I was sworn into service I pledged to fight against all threats "...foreign and domestic."

Not sure if this applies to the National Guard but the Posse Comitatus Act of 1878:
It generally prohibits Federal military personnel and units of the United States National Guard under Federal authority from acting in a law enforcement capacity within the United States, except where expressly authorized by the Constitution or Congress.
It applies to the National Guard when under federal control, but not when under the control of the governor of a state. That's why Bush couldn't call out the Guard for Katrina, but Louisiana's governor could. In fact, there are agreements between states to share their Guards.
Ah okay... See that's why I was confused. It's somewhat ambiguous around that.
I should have added, that's exactly why Bush said the Guard would not act in a law enforcement role on the border. They will provide for "administrative and logistical" support such as surveillance and duties that relieve the Border Patrol from non-enforcement duties like paperwork. Bush also mentioned the possibility the Guard would do some barrier or fence construction.
I think this is a good idea - while I am in no way a Bush supporter we need to shore up our borders. Now I am not sure of the legality of this move nor the actual ability for us to deploy the already thin Natl. Guard but we NEED to stop the massive influx of people across the southern border. Using the Natl Guard sends out a clear message that we are no longer going to allow free flow across the border. It will be a deterrent - if ever so slight- to the masses who are planning on coming across for money.
This will also allow Congress to instigate a legitimate program for integrating the migrants who are here while stopping the massive flow of new people. Its a good move overall and perhaps the only Bush plan I have ever supported.
I am not sure how adding National Guard for "administrative and logistical" purposes really bolsters the security of our border, or how this will inspire any forward progress on illegal immigration issues in Congress. I don't see the clear message you speak of, unless we give the National Guard beefed up border patrol duties and the Border Patrol jackets to make everyone feel better...
It's an interim solution designed to quickly provide more Border Patrol agents for front-line duty. The Guard will be withdrawn in stages as the new Border Patrol officers are hired and trained.
I love it how the President tells President Fox that it's not a military enforcement, it's the National Guard.

Depends on what they are doing. If they are not enforcing the law, it's not a military enforcement of the law. Seems simple enough.
