"I'm going to give you one warning to get out of my face."

Maybe the flight attendant took this statement the wrong way, I mean his breath was probably pretty terrible by that point.

Seriously though they pulled a stunt and deserve the punishment. The disregard to other passengers could have led to a dangerous situation had another passenger decided to stop it themselves.

I guess there are always two side to the story. According to the couple, whom have already hired a lawyer—the guy suffers from a chronic diseases and doesn't travel to well. He was just sleeping with his head in the woman's lap. Though, the lawyer did admit, slightly, that the guy was easily irritable, which means the "get out of my face" statement is probably true. Though, I admit, if I was feeling ill, and was trying to rest my head in my girlfriend or wife's lap and a flight attendant kept bothering me; I'd probably be irritated as well.

Oops, I forgot. I would assume if the couples actions were making anyone uneasy, other than the flight attendant, that the case should be easy to prove on either side.
