WASHINGTON — House Speaker Nancy Pelosi asked the Justice Department on Thursday to open a grand jury investigation into whether President Bush's chief of staff and former counsel should be prosecuted for contempt of Congress.
Pelosi, D-Calif., demanded that the department pursue misdemeanor charges against former White House counsel Harriet Miers for refusing to testify to Congress about the firings of federal prosecutors in 2006 and against chief of staff Josh Bolten for failing to turn over White House documents related to the dismissals.
She gave Attorney General Michael Mukasey one week to respond and said refusal to take the matter to a grand jury will result in the House's filing a civil lawsuit against the Bush administration.
The White House branded the request as "truly contemptible." The Justice Department said it had received Pelosi's request and anticipated providing further guidance after Mukasey's review. It noted "long-standing department precedent" in such cases against letting a U.S. attorney refer a congressional contempt citation to a grand jury or prosecute an executive branch. The top House Republican called it "a partisan political stunt" and "a complete waste of time," according to a spokesman.
The Democratic-controlled House voted two weeks ago to hold Bolten and Miers in contempt for failing to cooperate with committee investigations.
"There is no authority by which persons may wholly ignore a subpoena and fail to appear as directed because a president unilaterally instructs them to do so," Pelosi wrote Mukasey. She noted that Congress subpoenaed Miers to appear before the House Judiciary Committee, which is investigating the firings.
"Surely, your department would not tolerate that type of action if the witness were subpoenaed to a federal grand jury," Pelosi wrote.
She added: "Short of a formal assertion of executive privilege, which cannot be made in this case, there is no authority that permits a president to advise anyone to ignore a duly issued congressional subpoena for documents."
Pelosi sent an additional letter to U.S. Attorney Jeff Taylor, the chief federal prosecutor for the District of Columbia, whose office would oversee the grand jury. The letters point to sections of federal law that require the Justice Department to bring the House contempt citations before a grand jury to investigate.
At the White House, spokesman Tony Fratto said House Democrats "have been trying to redefine the notion of contempt and they succeeded."
Both Fratto and House GOP leader John Boehner said the House should focus on passing legislation allowing the government to more easily eavesdrop on phone calls and e-mails of suspected terrorists.
"Rather than passing critical national security legislation, they continue to squander time on partisan hijinx," Fratto said. Boehner spokesman Michael Steel said "this sort of pandering to the left-wing fever swamps of loony liberal activists does nothing to make America safer."
The chairman of the House Judiciary Committee, Rep. John Conyers, said he hoped Pelosi's demand would spur the department to "put the partisan manipulation of our system of justice behind it" and take the issue to a grand jury. "To do otherwise would turn on its head the notion that we are all equally accountable under the law," said Conyers, D-Mich.
But the department told the House leadership last July that it generally would not let a U.S. attorney make a grand jury referral or prosecute executive branch officials when they followed a president's instruction and invoked a claim of executive privilege before a congressional committee, spokesman Brian Roehrkasse said.
The letter was the latest chapter in a yearlong saga that began with the firings of nine federal prosecutors and led to Alberto Gonzales' resignation as attorney general last August.
The House voted 223-32 this month to hold Miers and Bolten in contempt for failing to cooperate with an inquiry into whether the prosecutors' firings were politically motivated. Angry Republicans boycotted the vote and staged a walkout in an unusually bitter scene even for the fractious House.
At the time, the Bush administration was no less harsh, saying the information sought by the House was off-limits under executive privilege and that Bolten and Miers were immune from prosecution.
It was the first time in 25 years that a full chamber of Congress voted on a contempt of Congress citation. The White House pointed out that it was the first time that such action had been taken against top White House officials who had been instructed by the president to remain silent to preserve executive privilege.

It has taken too long, and especially under the mis leadership of Pelosi, who appeased Bush's lies on Iran, and took out the clause against Congressional authority for permission to carry out another aggression, and who sat in secret sessions where she was told of the torture and secret camps, and said nothing, did nothing, and worse appeased the proto fascism and Zionist policies of both Amerikan empire and Israel's war crimes, violating international laws, the Constitution by failing to impeach the war criminals and telling Kucinich and others that she would not hold anyone accountable.

I don't think much of Nancy Pelosi, but she is certainly not an "imperialist corporate appeaser" and your not doing yourself any favors by going there. She is in fact, the Speaker of the United State House of Representatives and she deserves the respect for that position. If, like me, you do not agree with her politics or positions, then do something about it besides writing a lot of crap that no one pays any attention to.
I mentioned to you in previous comment that you are obviously down on the "Middle Class" and I know the Upper Class will not give any quarter to your kind of language ... so I ask you again ..... where does that leave you?

Nancy Pelosi is in the news! ...which is usually not a good thing. Once again, Nancy is up to nothing. I was brought up in the Tip O'Neal era ..... when the Speaker of the House Spoke and got things done!
I'm no fan of this do nothing administration, and I don't care if Miers and Bolton lied, or pissed on the Justice Departments carpets ........ I just want them ALL the hell out of the White House!
In my opinion, this is not what the Dems should be spending time on. The economy is going down the drain, our health care system remains status quo, we're still spinning our wheels in Iraq ...AND WE HAVE AN ELECTION COMING UP!
The Dems need to focus on the Nations problems and winning the up coming elections. Not just the Presidential race, but the House and Senate contest as well.
This move is going to do nothing except take attention away from the issues at hand. With so many different subjects to choose from, its hard to decide what to investigate first! I would definitely research his multi-million dollar, no-bid, government paid contracts handed out like gift bags to his favorite supporters!
In particular, I am very concerned with the money going to Africa. I understand that the former CEO of Eli Lily was given the job of heading up the Aid to Africa committee Bush formed! That country needs HIV/AIDS drugs and various vaccinations! Since Bush continues to extend the patents on many of these life-saving drugs, they are not available from America in generic form for some time. So the drug companies will survive having a Democrat in office because American tax dollars will pay some 30 billion dollars to them for meds to ship to Africa. Well, I agree they cannot afford this expensive life saving medication. But this deserves some looking in to!
Talk IS cheap. America please wake up. Get your information from a variety of sources because the media cannot be trusted any more than so many politicians.
A soothing speech cannot be your determining factor. I know your time is limited and you find it hard to spend a tremendous amount of effort doing fact-checking. But we're in a real mess and now is the time to demand the truth!

The Aid to Africa comment is very interesting. Since GWB is liked in Africa, it seems appropriate that he would attempt to hide loot there for his criminal buddies.

It is attitudes like yours that have contributed to the current demise of our country. Thankfully, we've somewhat begun to realize what is actually going on.
Over the weekend I rented a movie called "Rendition". It turned out to be a surprisingly relevant and informative film for today. The movie's main character, Reese Witherspoon, plays a pregnant mother of one whose husband didn't arrive at the airport following a business trip to South Africa. He was being tortured. Hence, the new, headline-making, controversial term, "water boarding". The movie hinted to its formal name, "extraordinary rendition", and I did some research. There is an article published in The New Yorker, dated February 29, 2008, describing the very story from the movie, having happened to a Canadian man who was taken to Syria to be tortured. It is a true story!
What left me feeling sad, more tolerant, and ultimately very disturbed, was yet another sign that my personal decision to continue to vote Democratic is a wise choice. You only need to visit the DNC website and read the policies for which the Democrats strongly represent.
The next direct threat is the legislature yet to be passed for drilling in the Arctic National Wildlife Refuge. In 1960 our then president Eisenhower protected this land. It is home to over 80 species of wildlife and would have disastrous impacts on them, the environment, and the Native Americans who live there. In 2005, a Washington Senator was rejected when she tried to protect a small portion of this land.
This "reconciliation" legislature, as it has been named, also includes many other unrelated legislature having nothing to do with this protected land. Its all part of a budget resolution. It includes spending in Iraq, among other things. How on earth did a major wildlife refuge get lumped in with wiretapping and Iraq spending?
You can write to the senate and ask them if they plan to protect the ANWF from oil drillers, who would benefit greatly if they found oil there. There is no guarantee the protected land would produce enough oil to bother going in, so why should they? Write to 433 Russell Senate Office Building, United States Senate, Washington, D.C. 20510. Now, how did I learn of all these details? I watched C-SPAN today, and I paid attention. Just thought I should pass it along.

Lots of nasty little roaches scrambling around because you have just been exposed. Quick, call your broker and ask what the next "best bet" will be! You have sucked our economy dry and there are many Americans who could use a helping hand. Give your money to the poor and give up the idea of "world domination", it's way over-rated. Trust me when I tell you that greed will make you sick! One cannot proclaim that money doesn't make you happy unless one knows from experience.
Democrats are on the way to, shall we say, level the playing field?
