Detroit mayor charged with 2 felony assault counts

Moments after a judge ruled that Mayor Kwame Kilpatrick could be released from jail if he pays a $50,000 bond, Michigan's attorney general announced he was charging the mayor with two felony assault charges stemming from a confrontation between Kilpatrick and a sheriff's detective.

The detective accused the mayor of pushing another investigator while recently trying to serve a subpoena on a friend of Kilpatrick. The two counts of assaulting or obstructing a police officer are each punishable by up to two years in prison.

"In my almost 20 years, first as a prosecutor and now as an attorney general ... I cannot recall ever seeing let alone hearing of a situation where a police officer trying to serve a subpoena was assaulted," Attorney General Mike Cox said at a news conference.

Kilpatrick spent Thursday night in a one-man jail cell with no TV for violating his bond in a criminal perjury case that has dogged him for months. Then Wayne County Circuit Judge Thomas Jackson altered the ruling of the lower court judge who ordered the mayor to jail.

Jackson said District Judge Ronald Giles went too far by not attaching some kind of cash bond to his ruling.

In order to get out of jail, Kilpatrick must pay a $50,000 cash bond and wear an electronic tether. He won't be allowed to travel.

Cox, meanwhile, announced the assault charges after state police wrapped up an investigation of the confrontation between Kilpatrick and a sheriff's detective, who accused Kilpatrick of the pushing incident in July while the investigator was trying to serve a subpoena on Bobby Ferguson, a Kilpatrick ally and possible witness.

Brian White, who works for the Wayne County sheriff's office, said Kilpatrick came outside of a house belonging to his sister, Ayanna, and threw him into another investigator. White didn't fall but said he may have a slight hip fracture.

Kilpatrick attorney Jim Thomas said the mayor will fight the assault charges.

"It's an allegation. Let's take it step by step," he said.

White is a lead investigator in Kilpatrick's perjury case. The mayor and a former top aide are charged with perjury, misconduct and obstruction of justice, all tied to their testimony in a civil trial last year. At the heart of that case: steamy text messages contradicting their claim that they didn't have a romantic relationship.

To remain free while the case moves through court, Kilpatrick was required to notify authorities about business that required out-of-state travel.

He admitted violating that condition when he went to Windsor, Ontario — minutes from Detroit — on July 23 to discuss the sale of the city's portion of a tunnel connecting the U.S. and Canada. He didn't call prosecutors or inform the court.

Saying he wanted the mayor treated like any other defendant, Giles on Thursday ordered the leader of the country's 11th-largest city jailed. Kilpatrick was transported to jail in a sheriff's van, photographed, given a green jumpsuit and placed in a one-man cell for high-profile people. He wore a tan suit to his court hearing Friday morning.

Earlier Thursday, Kilpatrick and Christine Beatty waived their right to a preliminary exam in the perjury case. That means those charges now go directly to Wayne County Circuit Court. Arraignment for the pair was set for Aug. 14. Both deny the charges.

And people wonder why Detroit isn't taken seriously? Now they have appointed Kandia Milton as acting mayor (aka Mayor McCheese) which legally should have fallen to the chief of staff I believe? The sad thing is that he IS the chief of staff. I'm pretty sure he took the gig after Kwame's former cheif of staff resigned due to being indicted with him. So yea... what was once the 4th largest city in the United States has fallen so far as to being run by the high school buddy of the mayor that is facing nine felony counts.

    That's true since Kilpatrick landed in hot water. It makes for some pretty awkward positioning especially now that Ma Kilpatrick barely won her primary to run to retain her Congressional seat this fall. The Obama people will have to tread carefully around that one as the top of the ticket is normally expected to appear with other candidates for office. All of this is going to hurt Obama in MI come November -- fairly or unfairly.

          I would like to thank Judge Giles for holding the Mayor to the same standards as a average citizen. Mr. Kilpatrick has treated this case and the others against him like a joke. He has done what he has pleased and will finally be held to his decisions. All the Mayor had to do was pick up the phone and tell people that he was going to Canada on city work. He could not do that and that is why he is in jail.

          The Mayor of Detroit has a few charges against him. He is being charged with not telling the truth in open court and also will be charged with assault on a police officer. He lied in court to try and cover up the fact that he lied about having an affair. A warrant was being served and the Mayor pushed the officer out of the way. The Mayor has acted like a thug since day one. He was nicknamed the "Hip Hop Mayor"Everyone knew he had issues but he was still re-elected last year.

          I feel the Mayor is trying to hold off until November before he steps down or gets kicked out of office. If he can last until then he will get a full pension and make around 150k a year for the rest of his life.

          Mr. Mayor please save the city any further embarrassment's and step down before it is to late. I urge the Governor to step in and kick him out of office if he will not do it himself.

          To Kwame Kilpatrick, it IS a joke. The reason for this is because all defendants are presumed innocent until proven guilty. And Kilpatrick knows that in Detroit, there is NO WAY he will be convicted by a jury of his peers. A conviction requires 12 guilty votes from the jury, which will be made up of mostly (if not all) blacks. There's no way the prosecution will get all 12 jurors to vote to convict "The Nations First Hip-Hop Mayor". In the end, the rathole which is Detroit will refuse to convict him, at which time we will all get to witness his mocking the legal system and listen to his boasts of how "racist America" tried to lynch yet another innocent black man in a position of power. Sad, but predictable outcome.

            But all it takes is ONE to nullify a jury. With this in mind, I feel that he got poor legal representation. His attorney should have known that the prospects of a jury in Detroit voting unanimously to convict the nations "First Hip-Hop Mayor" would be nil to none.
            This is in no way an endorsement of Kwame Kilpatrick, but rather an indictment of our current jury system. The current system is why extremely competent, high priced lawyers can get their rich clients off for crimes they committed. All it takes for some slick talking attorney to get his client off the hook is to convince ONE juror not to vote to convict, whether by twisting facts to confuse this one juror, or by playing on this one jurors emotions by planting racial questions into their mind. High priced attorneys are not only gifted as master manipulators, they are also well versed in psychological tactics.

                        I don't know anything about this mayor or his history, but I look at the facts that are being reported and something seems fishy. From the article:

                        How exactly does a police officer get thrown into another human being, rather than against a hard surface, NOT fall, and end up with a hip fracture of any sort?

                        The belts they wear are kinda hard. You don't know the bone health of the Detective in question so how can you make a judgment? regardless if he has a fracture, the push constitutes assaulting an officer.

                        I'm fairly sure even my 93 year old grandmother would not have fractured her hip on a belt buckle when she was alive. If the officer's bone health was that poor, I'd think he'd be unfit for duty. As for the push, so far as I am aware this fracture is the only evidence that a push even occurred. If it did, why was he not arrested by the officer on charges of assault at that time, rather than waiting for the outcome of this court case before the charge of assault was raised? If you were an officer, and your partner had just been pushed into you hard enough to fracture his hip, would you let the assailant go or would you arrest him then and there?

                        There is no outcome!!! I live here and you need to read a little more. The shove came a few days ago, the guy is a mayor of a large city and has a lot of thugs... I mean personal police body guards who are his friends from school around him at all times. If two county detectives tried to arrest the mayor, they would have been arrested by his "body guards".

                        You also do not know what the evidence is. it is standard practice for the county sheriffs' to have cameras in their car filming their activities. I am sure it is on tape.

                            I am one African-American Democrat who did NOT vote for him. Despite the investigations, many of us will never believe that he did not fix the 2005-election.

                            Mr. Kilpatrick also relies on his shady dealings with Big Business to keep himself in office. Like Jesse Helms, Mr. Kilpatrick exploits racism and ignorance. However, he wields them much more clumsily than Mr. Helms. And, granted, Mr. Helms (I can't even stand the man's memory) never engaged in such reprehensible behavior.

                            I know a little about Mr. Kandia Milton, Mr. Kilpatrick's temporary replacement, from personal experience. I would not trust the man with my garbage.

                            Michigan, when I lived there, often made fun of California's election of Arnold Schwarzeneggar. Michigan has some of the most hypocritical politics and mores that I had ever had the displeasure of living under. And, the Governator is actually doing a good job.

                              In Detroit politics, Democrat is pretty meaningless. To play in the city politics, you need to be a Democrat, people end up aligning on very strange issues.

                              The Mayor is about to go back to Jail

                              He was at his mothers house and his sister showed up. He stayed thus breaking the terms of his bond. He was to have no contact with anyone that has anything to do with the case against him. His Sister is a witness for the prosecution. Way to go Mayor another dig against the city. We are tired of your games step down and walk away!!
