Factory had tension between union, immigrants

LAUREL — Union bosses in this region of rural Mississippi have long grumbled that the largest factories here hire illegal immigrants, and that the immigrants were starting to get more overtime and supervisory positions.

Friction between the union and immigrant workers, along with a tipoff at an electrical manufacturing plant, boiled over this week into the biggest workplace immigration raid in the nation's history.

When the first of the 595 suspected illegal immigrants was taken into custody Monday, some fellow workers broke into applause. A spokeswoman for U.S. Immigration and Customs Enforcement said the investigation started three years ago after agents received a tip from a union member.

In interviews with The Associated Press, both union members and immigrants spoke of a simmering tension. At least one immigrant said scare tactics were used to pressure people to join the union.

Union members said they resented immigrants, who were often allowed to work as much as 40 hours of overtime a week when other workers were discouraged from doing so. All declined to give their names, saying they feared for their jobs.

Howard Industries, which makes dozens of products from electrical transformers to medical supplies, is in Mississippi's Pine Belt region, an area known for commercial timber and chicken-processing plants.

Robert Shaffer, head of the Mississippi AFL-CIO, said Wednesday that members have long complained that companies in southern Mississippi hire illegal immigrants.

"Jackson, Hattiesburg, Laurel and all areas along the coast, it's a little Mexico," Shaffer said. "I'm not against people trying to make living. I have a compassion for those folks. But at the same time, the taxpayers of Mississippi shouldn't be subsidizing a plant that won't even hire their own workers."

In 2002, Mississippi lawmakers approved a $31.5 million, taxpayer-backed incentive plan for Howard Industries to expand. The company, with 4,000 workers, is the largest employer in Jones County, which includes Laurel.

About 2,600 of Howard Industries' workers are in the union. Shaffer said he did not know whether any of those picked up in the raid were union members, or if nonunion workers were offered overtime while union workers were not.

Shaffer said offering immigrant workers union membership would depend on the situation, but he doubted it could be done if immigrants were in the country illegally.

Those detained in the raid came from Brazil, El Salvador, Germany, Guatemala, Honduras, Mexico, Panama and Peru.

Contacted Wednesday, Howard Industries referred reporters to the statement it issued Monday, which said the company "runs every check allowed to ascertain the immigration status of all applicants for its jobs. It is company policy that it hires only U.S. citizens and legal immigrants."

No executives were detained in Monday's raid, but a spokeswoman said the raid was just the first part of an ongoing investigation.

A 30-year-old immigrant from Mexico who has worked at the transformer plant for three years said union representatives pressured immigrants to join the union, sometimes visiting their homes, offering gifts such as shirts and indicating that if they joined the union they would make more money.

The immigrant, who was not caught in the raid because he works the night shift, spoke on the condition that he be identified only by his first name, Jose, because he was concerned about being detained.

"The union uses the tactic of saying immigration was coming and the members of the union would not be taken," he said through a translator.

Jose said he did not join the union because he wasn't convinced it would come to his side if he were detained, and he felt his dues would not be returned.

At least eight of the workers caught in the raid face criminal charges for allegedly using false Social Security and residency identification.

On Wednesday, hundreds of people lined up outside the plant to apply for jobs as news of the raid spread. A billboard had gone up last week, before the raid, saying the company was hiring.

"I need a job and got kids. I heard that they need some help now," said Willie Keys, 20, who applied Wednesday. "All them Mexicans got fired because they didn't have a pass ... All these businesses have been taking Americans' jobs."

The unemployment rate in Jones County was 6.5 percent in July, slightly higher than the national rate of 6 percent but below the state's 8.5 percent rate.

William Gunther, an economics professor at the University of Southern Mississippi, said Mississippi has a labor shortage because people aren't moving there, which could explain why companies might hire illegal immigrants.

"That leaves businesses with a serious problem," he said. "That doesn't justify, but it certainly explains why they might be hiring individuals who show up and say, 'I'll work for you.'"

He said businesses could face higher wage costs and consumers could face higher costs for products and services if immigrants are taken out of the economy.

Ruben Castro, who owns La Fiesta Brava Mexican restaurant, is already seeing the effects. He had to bring in workers from a store in another town because he was so short-handed after the raid, when five other Mexican restaurants in Laurel closed because employees were afraid to come to work.

"It hurts the community," he said, because the town will lose 600 people who frequented stores like Wal-Mart and paid sales taxes.

Says it all.

Two things in the article need de-spinning, however:

  1. This is not a union issue. This is an issue of illegal aliens displacing American citizens from jobs in their hometown.
  2. The arrested individuals are not "immigrants" - they are undocumented illegal aliens in violation of the law.

I hope Howard Industries gets a lot more than a slap on the wrist. The number of local applicants absolutely puts the lie to any assertion, including the one made by that academic - William Gunther - that there aren't enough local people who want to fill those jobs.

(BTW, when are we going to stop listening to academics? They don't live in the real world, don't know what's really going on, and don't have to live with the consequences of their bad advice.)

I have to agree with both points. And-- isn't it interesting the spin they put on the story..i.e. callling them "immigrants"...!

And this, boys and girls, is where the journey to a solution begins.

The company policy may be to hire only US citizens and legal immigrants, but if the process to tell what status these people are fails, then change THAT @!$%#ing process.

And then there is this. Poor Wal-Mart... multi-billion dollar conglomerate might have to tighten the belt a notch for a month or two. Yeah they paid sales taxes, which pale to federal and state taxes, medicare and social security. But, it goes back to the underlying point of the root of most of this issue - money.

Amnesty might be an option, but people have to learn to play by the rules.

If you think the U.S. has harsh immigration laws, try Germany or Australia. There are others. Some countries detain you for two years or more...and then deport you.

sure walls and all that.. I hear ya but they really don't stop desperate people.. maybe slow it down a bit.. bu ask germany.. ti really doesn't stop the desperate.
plus there have been tunnels.
crack down on the companies sure.. but if they just choose to move the factory to mexico?? then what? ok farms are a bit firmly planted here.. or atleast we have some great farming areas.. so are we only going to harrass them?
what about the huge companeis like nike and others that use foreign labor int their home countries? and what about companies that just buy all their stuff from other countries?? isnt that sending our jobs there too?

just saying "screamign wall" is fine and dandy but really doesn't address the problem at all.. things are a bit more complex. You really have to step back and see what america needs and what we can afford to send over seas, or share with our neighbors down below. But first we have to address what americans need. Just throwing up a wall does none of that.. it is a non answer.. it's avoiding the problems. Not sayign we shouldn't have a wall or w/e.. it's just not ggoing o have the effect many are dreaming it will.

cute bumper sticker slogans and bandaids never really fix any serious problem.

Then when its made in mexico, he has to bring it all in from the border, pay taxes, pay freights, etc.

    This is the problem with the illegals, they're not just here to do unwanted jobs, they're taking our jobs with cheap labor. They can do this because they are not required to have the same education, training, personal tools etc. They don't need vehicle insurance, or to provide for their own medical needs. They live several families to any house or apartment, something the city zoning folks would clamp down on US citizens for. Their kids get school lunch programs and are subsidized by food stamps and other social programs, ours are not, they are supported by us with no help because we have social responsibility.

    They are dealing in illegal narcotics trafficking, prostitution, and identity theft rackets, not to mention the gangs they have formed, (because they can't make enough of a salary on the jobs they stole from us).
    They are entering our country without inspection bringing with them near epidemic levels of tuberculosis, hepatitis C and recently, a mutation of measles that is drug resistant. Why is it that our government can't seem to understand, WE DON'T WANT THEM HERE, send them home!!!

    Compared to the relative few illegals and/or legal immigrants dealing in drugs, the ones who come here illegally and drain other resources(ie healthcare, schools, welfare) far outstrip the resources used in the so called 'war on drugs"

    Ironically, it is the illegals that come here to make an honest buck who are the biggest drain to the American taxpayer.

    Smiley, the point of this site is to discuss differences of opinion and try to produce some clarity of the issues of the day. Go2Guy is acting on emotion and painting with a very broad brush, that seems clear enough. You shouldn't let him get the best of you. You step equally over the line when you start making assumptions about people and insulting their mothers.

    Remove emotion and the fact remains that vigilent enforcement of our immigration laws is far overdue. I would be interested to hear what you have to say on that matter.

    Immigration is driving the need for bilingual education. school districts are increasingly going to spanish speaking countries to fill this need. American monolingual teachers are bing displaced and soon, if this continues there will be lay-offs for teachers who dont speak spanish.

    first it was the factory worker and contractor loosing his/her job, now its the teachers, next it will be YOUR job.

    I'm not sure how you blame that on illegal immigration. Legal immigration, global trade, and a bunch of other reasons would cause the same new skill requirements. As a professional, I have to learn new skills all the time - if you have a masters, I'm sure you're capable of the same. Yep, these illegal immigrants are going to displace an American teacher with a masters degree - not.

    And, you have a masters, but you don't know the difference between "loosing" and "losing?" You did that twice, so I don't think it was a typo.

    I don't @!$%# when a new computer language comes out. I learn it. Our State Department and other folks don't @!$%# now that they have to learn Arabic and Chinese instead of Russian.

            Walls and fences DO NOT work. It's been tried before. The Berlin Wall, double-barbed wire fences with machine guns, lights, and dogs around Rumania, Bulgaria, etc. People still find ways to get through if they are dedicated enough.

            My best solution is the article I posted above. I don't mind posting the link for two reasons. First, I think the issue is important. Second...it's an AP article, anyway.

            in my case, the demand for bilingual teachers is not driven by global trade but by illegal immigration. In my school district, 70% of students are hispanic, with over half of them being illegal. the school district is forced to hire spanish foreigners to meet this demand. these teachers take jobs that would have otherwise gone to american teachers

            therefore, americans loose jobs to foreigners. all this driven by illegals

            hope thats not too hard to for you to understand

              It is good to see the ICE is finally stepping up and enforcing the laws. I hope this is just the beginning of things to come.

              How stupid do they think we are? This company should be heavily fined.

              JoulesBeef - The issues of moving companies to Mexico or buying products made overseas is a separate issue. Like every other country, we have immigration laws. It's about damn time we started enforcing them. I for one don't consider enforcing our immigration laws as harassment.

              JoulesBeef, Sounds like you want some suggestions on changing things not just complaining about them; here you go. BUY AMERICAN from companies that hire Americans. The idea that we are being held helpless by these corporations that hire illegal workers and take away our jobs is insane. We can control the profits of these slave masters. Simple enough, stop buying from them. Many people frequent places like Wal-Mart because they can't afford to shop at the more expensive local stores. This corporation is able to bring us great savings because they short change their employees on wages and benefits forcing them to use social services to survive. We end up paying the freight anyway with extra taxes. Enough is enough; they want to bend us over a barrel so I say stop buying from them. If they decide to move their factory to other countries, let them see how profitable they are without the American Market for their goods. Heck, at the rate were going we wont be able to afford anything anyway pretty soon. Here is a link to US Made products:

              I would also take the time to write some of your favorite corporations with your disapproval of their antics and the message that they have lost you as a customer. I would also copy these letters to your elected officials so that there is no mistake how the American people feel about this. I'm sending a letter to Hershey's, the chocolate makers who founded their company in Hershey, Pennsylvania but have now closed the factory putting one thousand American workers out on the street and moved to Mexico for cheap labor. I really liked their product and it has been hard to not buy a candy bar but I will never buy their products again to support what they have done to their employees.

              The corporations always want more money from cheap labor, and you can do nothing with that - that's called "globalization". But the idea to buy the only things made in the USA to support our labor force seems to be reasonable, the only issue – it's not easy to find them those days.                   I just want these people to hear it as well.. cause turning off the flood gates won solve the problem. Unless you are a farm worker the factory will simply move to a place where the labor is cheap.
                  they'll do the same as we tighten our emission laws as well.. it is something we will have to address to stem the tide of jobs going away.. weather that is actualize improving education so les people need jobs with low educational requirements.. or using taxees to encoruage companeis to stay here.. to invest in the usa

                  but rgiht now they all avoid taxes.. which is fine.. as long as they are being productive american businesses.. when they start to invest jobs and resources overseas I question how we let them get away without payign taxes while hurting this country.

                    And I'll bet there are a lot more. It's unfair to those citizens who have their identities used in a fraudulent manner by criminals. It's unfair that it isn't better enforced.

                    A woman on another thread said that her husband is illegal, but that he pays taxes and is a kind person. I asked her, if he pays taxes but is illegal, whose SSN is he using? Because he sure as heck doesn't have his own.

                    He may be using a Taxpayer's Identification Number. It wouldn't be on a SSN card but you don't have to show an SSN card to prove work authorization. That's just one possiblity. Learn more about employment law, katrix.

                      This is a huge issue we need to face and it isnt just illegal immigrants and jobs.

                      The rich corporate entities will use people to make more money. This happens all of the time in poultry plants. The breadth of this nuevo "slavery" isnt really known. The fact that we know this is happening speaks for itself.

                      These rich aholes are doing it to our troops in Iraq.

                      Lets say they get paid $50k a year from the government for a truck driver and they get paid 90k a year for a radio operator. The jacknapes send a radio operator contractor to Iraq and that person takes the job of one of our soldiers who in turn gets to drive the truck. This happens all the time in Iraq. I wonder how much of that 200 billion a year that is being stolen from us would be saved if our Army let the soldier do the job he is trained for and make the contracting company send truck drivers.

                      All of these issues could be resolved if our government truly represented the people. Unfortunately our government represents corporations and dynastic wealth.

                                Will there be a similar raid in a large urban area like NYC, Chicago, or Los Angeles? Not too likely.

                                I don't get why it took some 3 years for this investigation to reach the conclusions that the townspeople or police could have easily confirmed--that undocumented workers were being hired with impunity.

                                  In the northern part of New Mexico, there are a lot of illegal aliens.
                                  In the south, Border Patrol has checkpoints...you don't see illegals, and if you do, they get sacked up and sent packing...
                                  It is an enforcement issue...not enough will to do the job...by congress, the president, and local officials!
                                  The only people that want enforcement seem to be the American people.

By the way maybe you have not notice is a world economy not a U.S. economy anymore, unions have help destroy our ability to compete with other markets and still try to keep a hold on the companies that are here, is not about immigrants legal or illegal is about competing with companies from Europe and Asia, get those immigrants out of here send them all back, and sit back grab a beer and watch all those towns across the U.S. collapse with their economies come to a halt. Oh, by the numbers there is more U.S. citizens in welfare, medicare and food stamps than illegal aliens, and WE all pay for it.

                                          This issue is much greater than simple illegal immigration. Sure it has its roots in the hiring of illegal workers by Howard Industries but if you take a step back and look at it from afar you realize that this is a very tangled web.

                                          Howard Industries is (trying) to make goods at a profit
                                          Howard Industries is a company producing goods in the US (e.g. "Made in the US" products)
                                          Howard Industries is competing against Chinese companies producing similar products

                                          Now, the Chinese companies are able to produce the same (or similar) product at a much lower cost because their labor is cheaper, they often don't pay benefits, and a myriad of other reasons. So, Howard Industries has to compete with that lower price or shut down the plant. Hence the search for cheaper (lower cost) labor.

                                          Sure there might be all kinds of legal workers available but they want "union wages" and those wages are often much higher and include all sorts of benefits not necessarily afforded to non-union employees. Union labor (and this isn't a rant against unions) cost much more than non-union labor and one doesn't have to think too hard why non-union labor (legal or illegal workers) is the preferred choice of most industries.

                                          Now, does the cost of labor condone what Howard Industries has done? No. But it highlights the need for potential union reform. Because if we don't we will continue to see the shifting job picture as more and more companies opt for overseas factories.

                                            Sandjockey, I understand your point but, even though I understand, the reality is that for us (Americans) to survive as anything beside slaves in this global economy we are going to have to figure this out pretty quick. The sad fact remains that the upper management of many of these companies are making obscene salaries/incentives by cutting out the American workman to do it. They achieve their greedy goals through hiring the illegal workers or off shoring our jobs, forcing no full time schedules to avoid having to provide health insurance and in the case of corporations like Wal-Mart, forcing their employees to seek social services to survive, all at the expense of the American taxpayer. Government isn't guiltless in this situation by a long shot. Beside all the alleged corruption and special interest follies we hear about on nearly a daily basis, we also must deal with unbelievably inept and totally inefficient operation of the very government systems we depended on to safeguard much of our American Way of Life. Think of China at Christmas time and the toys we were supposed to give our children. American manufacturing couldn't compete with all the safety standards they must follow here but the Chinese just ignored their responsibility and manufactured dangerous products. This is where our systems have failed us in some respects by making it harder here in our country to be in compliance with our laws than nearly any other country on earth. Add to the fiasco, cheaper labor, labor based on people who only know living conditions that Americans progressed beyond a century ago, and you can see why our fat cat big business leaders have gone globe hopping with our jobs. NO, I want neither additional government nor do I expect they are to provide for me from the cradle to the grave; I just want a fair shot at be able to survive again. My industry; as one of the others pointed out; construction has been nearly destroyed by the illegal alien workers. This I know intimately from having my whole livelihood taken away and now face losing everything I have worked my whole life for, Oh well, I'm just another statistic in an economy run by greed and giving what were once my dreams to our global neighbors.

                                              Sadly we (America) will never be able to compete with the 3rd World Countries in terms of reverse salary parity. If the standard of living is such that the American laborer is requiring 20 times more pay for the same job then the result is automatic. The job will go overseas. That is capitalism at its finest and there is little we can do about it.

                                              Yes, "Joe Manager" or "Joe CEO" make what some would call ridiculous pay but again that is capitalism. How do we fix it? I believe we go back to small business, not large conglomerates. I believe we go back to employee owned business, I believe that in many instances we have to eliminate the role unions have played (many unions have overstayed their need).

                                              However, that isn't all that is needed. Sadly many of our workforce believes that they are entitled. Entitled to the high pay, entitled to great benefits, entitled to a job. They aren't. All that has to be earned and unless we can change the work ethic in this country then we have even bigger problems ahead.

                                              After all, isn't it now almost easier to sit at home drawing unemployment than to seek out a paying job?

                                                You can't have it both ways...companies are expected to make profit. To do so they have to compete against other companies. Americans en masse are not willing to pay higher prices for comparable goods. I don't care how many people we get here saying "Well, I'll buy American!", you are a small drop in the ocean. And using big statements like "I'm not buying blah because they ship jobs overseas", etc. typically comes from people who haven't been put into a situation where they HAVE to buy the said "blah".
                                                So people want low prices for products, company has to make profit. I don't fault the company for going down this route...sure, government agencies failed. Try explaining that to your shareholders. "Sorry, guys, we are being undercut and nobody can protect us, so...well, it's been a good run" does not fly in business world.

                                                Also, and this seems to be going over a lot of people's heads...
                                                NOONE IS ENTITLED TO A JOB.

                                                Like the teacher with masters above, crying about how the monolingual teachers are on their way out. Hmm...here's an idea: adapt to the changing world and learn new language.
                                                I'm a software designer. When new language comes out and my company expects me to use it do I go crying to my boss about it? No, I learn the new language.

                                                The essence of capitalism is "win at all costs", in case that hasn't sunk in yet. Companies know it and they WILL ship your job overseas if it produces profit, even short term one.
                                                The happy happy joy joy "get a job for life" years are over.

                                                  I think this is worth another article - written by someone who knows more than I do about it. But the whole topic of unions is interesting. Certain industries still definitely need unions - coal miners being at the top of the list. Other industries are harmed by them. The auto industry is one. Every business has to make a profit, or it will fold, and its employees will have no jobs. The auto industry can't afford the benefits and pensions the unions made them promise. The Federal government is another case - Federal civil career employees need to be protected against political backlash, but is a union the right way to do this these days, when it keeps badly performing employees from being fired? The whole union concept of rewarding "length of employment" instead of "merit" sucks to begin with, both in private industry and government. It encourages the mediocre employees and discourages the good ones. It's like a bell curve for employment.

                                                  How do we decide which industries do or don't need unions? How do we keep the union demands for fair wages and benefits from killing the companies, and how do we keep the companies who can afford to provide good benefits from screwing their employees? How do we encourage good people, and get rid of the worst ones?

                                                    As you can probably guess, I am not a union supporter. Never have been and doubt I ever will be. As katrix mentions, unions have outlived their purpose in many industries. From the automotive industry on down unions started off with a great premise, help the worker gain equal rights for their efforts within an industry. Sadly those "equal rights" turned into millstones around many company necks and we, the consumer, end up paying to lighten the union load. But wait, the union employees are also consumers so now the union has to fight to raise their salaries and benefits which causes, in an ever vicious spiral, an increase in prices leading to another increase in wages and benefits and so on and so forth.

                                                    I am a small business owner who tries to pay living wages to all his employees and who also firmly believes in incentives as a way to augment an employees pay. Those who deliver based on mutually agreed upon targets can more than double their pay. Those that don't, for any number of reasons, get their basic pay. Guess what. Unions do not like this system and fight to end it. Why?

                                                    By creating a system, as most unions do, that mediocrity is paid just as well as excellence, you end up promoting mediocrity which, sadly, becomes the "new" excellence. Sad but true...just look at our school systems today.
