TAMPA — A 21-year-old man was charged with first-degree murder Tuesday after police said he snatched up his ex-girlfriend's 3-month-old son during a fight and then threw the baby from his car on an interstate highway.
The child's lifeless body was found near Interstate 275 north of downtown Tampa early Tuesday. The man, Richard A. McTear Jr., was captured several hours later. Deputies said he is not the child's father.
The Hillsborough County Sheriff's Office said McTear was arguing with his 17-year-old ex-girlfriend, Jasmine Bedwell, at her apartment when he began beating her and the child. She reported that McTear threw her son, Emanuel Wesley Murray, down on the concrete, then picked him up and fled in his Chevrolet Impala.
Jason Bird, a news photographer for WTVT-TV in Tampa, spotted the baby's body on his way to work at about 4:30 a.m.
"On the side of the road, I saw something out of the corner of my eye and at first I thought it was a baby doll, and then as I was thinking about it more I thought that was awfully big for a doll," Bird said in an interview on the station.
He turned around and went back to take another look.
"It was laying there with its eyes open," he said. "I couldn't look at it. It freaked me out, but fortunately law enforcement came right away."
"It's hard to find words to describe why someone would do this to a poor, defenseless child," sheriff's Maj. Harold Winsett told reporters at the scene.
Deputies located McTear's car at his home. Witnesses told deputies where he could be found, and he was arrested about four hours later after a foot chase.
McTear also was charged with burglary with a battery, felony battery, aggravated child abuse and kidnapping, said sheriff's spokeswoman Debbie Carter.
McTear had previously been arrested on charges including felony battery, aggravated assault with a deadly weapon and domestic battery by strangulation. According to the Florida Department of Corrections, McTear was sentenced to two years probation in June 2008 on a felony battery conviction. An arrest warrant was issued when he failed to report.
Last month, Bedwell sought an injunction against McTear for domestic violence, but the case was dropped because she didn't appear in court.
In court papers, Bedwell said McTear was violent, often armed and had a drug problem. She said he had forced his way into her apartment and beat her.
McTear had not yet appeared in court and did not yet have an attorney.

It was not the mother who beat the child, but her so called boyfriend, who was not the child's father. He should never be allowed to go free for having done this horrendous crime! Isn't it awful that some women will stay with a man who is violent and abusive? Yet it is not a new story on that level. She needs care and counseling and a lot of help.

I hope I get to read it. I was abused, too, by my ex. We had no kids, which turned out to be a blessing, but I know the dynamics of abuse and I don't get it, either. I do believe that abusers cannot reform... I've never heard of it, anyway... abusers are sociopaths, narcissists, totally self-absorbed, and they also feel impotent, thus they have to pick on someone who cannot fight back. It makes them feel powerful... and they do not understand why they do what they do, nor how destructive it is.
Funny, but abusers seem to think they can beat someone into loving them... insane, yes, but that is what they seem to believe...

OMG that poor child! I know it is "hard" to get out of an abusive relationship for some people, but I sure as he11 would get out before any of my children would get killed. For me? The first slap or hit and I would be gone. Period.
They must have been arguing outside as the story states he threw the baby down on the concrete and then picked the baby up. Where were the neighbors? You mean to tell me no one heard, or no one wanted to get involved? Where are this girls parents, she is only 17?

First of all it sad that poor defenseless children that do not ask to be brought here have to pay for the parents actions. I agree with another poster, where in the hell was the girls parents when they're daughter and grandson were being abused and then again when it came time to go to court to see to it this sorry excuse for a human being could not harm the mother and child again... This poor little angel lost his life and it could have all been avoided. If you take a look at his prior arrests they consist of felony battery and domestic violence by strangulation and assault with deadly weapon. I mean hello is anyone paying attention why in the hell is someone like this released on probation? I mean I've heard of 2nd chances but eventually you have to realize that some people dont change. I mean after the 1st ten arrests you would think they would stop giving him a slap on the wrist. I pray for this child and I know he is in Gods hands now so he will never have to suffer again.

This article demonstrates that he had some serious issues going on. The baby was only 3 months old and the killer was not the father......sounds like that was part of the problem. He took it out on the baby to hurt the girl, now he has to live in prison with people worse than him. He sounds like a real bully and too bad that young lady had to lose the baby to lose him. He'll find out what kind of bully he really is where he is going.
I'm not sure there are people worse than him.

That is my thoughts exactly. It may cost the tax payers money but put him in prison for the rest of his life without possibilty of parole, in general population, let him see what a bully is, people like him are hated among the prison population.

when I read this story and saw it on the news I welled up with tears just seeing this take place in my mind then the guy who found the baby said his eyes were open, I cant even imagine the pain that must have been on that baby's face, that expresion forever locked on his beautiful face,I pray that God please remember this beautiful child and give him life again some day, as for the murderer, he will definitely reap what he has sown, and in his cell, they should put pictures of this poor baby's face all over the walls so that he can forever be reminded of why he is being punished so brutally, and let it slowly eat away at him till the day he dies

ok just a little update on the scum of the earth baby killer.... He is being protected by the system. They put him in his own cell away from everyone... they say 4 his own protection... Well who in the hell was protecting and looking out 4 that poor little innocent baby... No one was there to keep him safe from this sick scum so why in the hell should he recieve any kind of protection.. Let all those guys up there know what he did and let them have at him.... There is so much violence against children in this country,that it sickens you.I'm watching the local Wilkes barre news and some @!$%# has been arrested for shaking a baby so hard that it died.His lawyer is claiming he had an invisible friend named Barney(I @!$%# you not)But it won't do him any good in this state.Life without parole.Now if that guy in Tampa did that here,I think we would execute him and I'm pretty sure Florida will too.
There was a case somewhat like this some years ago in Massachusetts. The guy threw the baby against a wall and killed it; then he tried to patch the wall. He got caught while the paint was still wet. He got lucky in court, a hung jury because one of them was blankly staring out the window waiting for a "sign from God". At the second trial, the jury didn't wait for the coffee to get cold before convicting him. So should it be for this guy, and maybe even quicker. Sure, he's nuts and violent and if society gets true justice, he'll become suicidal pretty soon. A lesson for all those dumb as a rock women who like "bad boyz".

I can understand being in an abusive relationship, but when you have a child, it becomes something different all together....the abuser better watch their ass!!! I would be like a mother lioness when it came to my baby, and all of that poor helpless me has to go somewhere. I dont think the girl was in a strong enough place to do that, doesnt sound like she had family support or anything like that...theres another thing that I do in relationships, and its called background check.....this guy needs to go to prison, and all the inmates should be told what he did. He will get his, just like ole Jeffrey Dahmer. I put all freaks in the same category. At least Dahmer didnt go after children.
