Nancy Garrido’s lawyer: ‘She seems a little lost’

— The attorney for Nancy Garrido, the California woman accused of helping her husband hold Jaycee Dugard captive for 18 years, said Wednesday that her “state of mind” could become a defense issue when the sensational case moves forward in court.

“She’s distraught. She’s scared. She seems to be a little lost,” Gilbert Maines told TODAY’s Meredith Vieira. “She doesn’t seem to be able to really focus well at the moment.”

Maines, who was appointed by the court to represent Nancy Garrido, said he has spent just a couple of hours with his client, whom he last saw on Saturday.

“I am five days into this case. I spoke with my client for two hours. I can’t say right now that I’ve formed an opinion of who she is,” Maines told Vieira.

‘A robot’
But he did say that his client thought of Dugard and the two daughters she had by Garrido’s husband, Phillip, as her family. The two girls are now 11 and 15 years old; Dugard, who was kidnapped from in front of her home when she was 11, is 29.

“What she said that I can tell you about is that there came a time when she felt they were a family, and she loved the girls very much, and she loved Jaycee very much,” Maines said. He added, “That seemed a little strange under the circumstances.”

Phillip Garrido’s brother has been quoted as saying that Nancy Garrido was “under his [brother’s] spell.” He described her as “a robot” who would “do anything he asked.”

Maines declined to discuss any specific plans for Nancy Garrido’s defense. According to reports, it was she who allegedly snatched Dugard from the street while her husband drove the car they were in when the girl was kidnapped in South Lake Tahoe in 1991. Two years later, in 1993, she had sole custody and care of Dugard while her husband served months in jail for parole violation on an earlier offense.

Vieira asked Maines how Nancy Garrido could argue she had no knowledge or control when she was alone for that much time with the girl and did nothing to free her.

“That seems to be a fair question,” Maines admitted. “The argument goes to her mental condition at the time, not so much what physically happened. I don’t know that I can argue successfully that she didn’t know what was going on.”

Vieira asked if he would suggest that Nancy Garrido was the victim of mind control.

“I would be derelict in my duty if I didn’t pursue every avenue that was available. One of them would be her state of mind at the time,” he said. The attorney said that he will seek to have his client evaluated by experts to determine her state of mind.

The Garridos’ story
Nancy Garrido, 54, met Phillip Garrido while he was serving 11 years in prison in Leavenworth, Kan., for rape. They were married while he was still behind bars.

The couple lived in a compound in Contra Costa County, Calif. Dugard and her children lived in a warren of tents and outbuildings hidden behind fences in the backyard. Neither parole officers who checked on Phillip Garrido nor local police who visited the compound after neighbors complained about the tents ever discovered the captive woman and her children.

Garrido ran a printing business from his home and also claimed to talk to God. He was captured after he visited UC-Berkeley and told a campus police officer he wanted to hold a religious event at the university. He had Dugard and their two daughters with him.

The officer, her suspicions raised, arranged a meeting the following day, at which time the Garridos were taken into custody and Dugard’s true identity discovered. Dugard has been reunited with her parents. Her daughters have reportedly been told that their father kidnapped and raped their mother.

Police searched the Garrido property for evidence that might connect him to the unsolved murders of nine women. That search turned up an unidentified bone fragment, but no direct evidence to link the Garridos to the murders.

Phillip and Nancy Garrido are being held without bail. They face 29 criminal counts that could land them behind bars for life, including rape and kidnapping. They've both entered not guilty pleas.

The assistant district attorney says Nancy Garrido is legally charged with rape based on the theory she participated in it. They don't have to prove she physically raped Jaycee Dugard, according to the prosecutor. He says they just have to prove she aided and abetted the crime.

I hope both get life without benefilt of parole. It's hard to imagine two perverts as these. To be so cruel to a child and keep her confined with no education, not seeing a dentist or doctor and impregnating her twice and delivering two babies without benefit of midwife or doctor is unthinkable. These three unfortunate females will never lead normal lives. May they and their families be able to live without being scrutinized by the media.

I can't believe they're trying to put a "human" twist and perspective on this woman, who's just as guilty as her husband. Shame on that defense attorney of hers, the crime she committed is evil and cannot be defended. How a woman can stand by and let another one of her kind get raped and impregnated multiple times, and still stand by that man's side is beyond me. I don't buy that she loved Jaycee or those kids or she would have tried to put a stop to her husband and get them out of there; she's just not the best judge of character considering she married a man that was behind bars for rape. In short, I don't believe her insanity defense and hope the jury can see right through it and convict her accordingly.

The nature of the crimes are so despicable , that there will be no public sympathy for a pair of evil, calculating, conniving, whack jobs .

I have no doubt that Nancy Garrido did and does love Jaycee and the kids. That is how people are. Kids abused by their parents love their parents anyway. They also can hate them, feel angry, everything else, but people are not one-dimensional.

Similarly, parents who abuse kids love their kids too. They don't usually hate them. Parents who kill their kids are usually genuinely sad they did it.

And Jaycee doubtless has positive feelings toward the Garridos. He is the father of her kids. She isn't the first woman to have sex with her father-figure. Women tend to love the father of their children, it's just natural. She will also have anger and all the rest of it, but it isn't going to be what people tend to think.

That doesn't mean that the Garridos shouldn't stand trial and go to prison for the rest of their lives. That will be very hard on Jaycee and the kids, but it should happen. Just because people are not entirely awful doesn't mean they shouldn't pay for what they did.

Even Adolf Hitler, Josef Stalin and Mao had people that loved them, that they loved. And they were arguably the worst people the world has ever seen with their mass slaughters.

One reason for trying to put the "human twist" is that a majority of people do not know how easily many mentally-ill people can "flip a script". But it is strange that people from the court system, many of whom come in regular contact, with the mentally-ill do not recognize this phenomena.

    I agree with ATOwen. While he will be in the media spotlight, Maines was "assigned" to the case by the court. While our Constitution may be taking a beating, it does still guarantee competent defense. What I'm grateful for, at the moment, is that no one has volunteered to do this pro bono because of the high profile nature. Of course that might change - then you'd have a valid point.

    And while it is his job to provide a good defense, it's possible the position he is in sickens him to death. And know this, if he fails to give her adequate defense, the case could be tossed (or more likely a mis-trial), and the defense attorney tossed in jail, himself.

    And Maines is being honest I think. Nancy is a very screwed up lady. She loved Garrido, and probably always will.

    Just because people do terrible things doesn't mean that they are not human. It is very rare to find a person who is so sociopathic that they truly have no human feelings.

    Gangsters love and have families. So to pedophiles and rapists. It's kind of disgusting to think it, but they also feel the same things that everyone else does. It's just that they do things nobody else would do.

      Just remember that if you ever happen to be falsely accused of a horrible crime, there will be someone out there willing to represent you and you will be glad of it.

      That being said, I think these two are guilty and should be hung from the highest tree, side by side.

            Insanity defense. Kind of saw that one coming. Jaycee should be given every penny that these people had and then they should be locked up forever. Since her children were fathered by him, the assets owned by him could very well be called child support. Garrido and his wife owe her much more but it would at least be something to help pay for all the counseling they will need.

            People are human, even when they do bad things. We have a need to think of them as non-human, so distant from us that they couldn't feel anything we feel.

            Reality is very different. This isn't a TV show. The lady is complicated and has human feelings. Doesn't mean she shouldn't go to prison for what she did.

            ...yeah, duh? The girl was a sex slave. What backwater town does this woman come from that she finds it normal to have forced physical relations with family members, or to stand by and watch as her husband has babies with someone who is a child?

            If you bond with other people long enough to consider them family, that's fine. It's okay to love a little girl, but it's NOT okay to LOVE a little girl!

            You are totally right Tor.

            Nancy was a pawn of sorts. She probably thought of herself as working on her husband to make him better by loving him. That's a very normal thing for a woman to do or want. Nancy is way out there in terms of what she is willing to allow to happen around her, in her "family". But that is a matter of degree, not an absolute.

            After all, how many women have bought a nice dress for a great price and cared nothing for the terrible suffering of the people literally enslaved to make it? How many women have not cared how their gangster husband made his money? There are parallels.

              My husband is the most important thing in my life, I cherish him. (we have no children) With that said, if I found that my husband was in any way harming children or women, let alone what this monster did, he would be toast. No if - no ands - no buts. Don't care what his problem is, dropped on his head, Mommy didn't love him, drugs, urges, what ever. He is done. How do loves someone and knowingly let them be raped, over and over, day after day, week after week, month after month, year after year. Also Mrs. Monster KNEW what she was getting into, he was in jail for rape when she met him.

              You're absolutely correct. I feel the same about my husband, but if I ever had an inkling that something like this involved him, it would take all of about 2 seconds for me to contact the police and then boot him to the curb.

              If she had loved Jaycee she never would have allowed any of this to occur, including the kidnapping. She's an opportunist - she sees a possible way out of this hideous crime by pretending she not only loved Jaycee, but by acting as if she's uncertain what's going on. She knows exactly what's going on and that is that the gig is up.

              Suck it up Garrido - you went along with it, now you pay for the crime too. I have absolutely no sympathy for either of the Garrido's. I hope they both burn in hell.

              Her lawyer's setting her up for an insanity plea...how else can she be defended? Letting the info out of her meeting/marrying that freak in prison for being a rapist....bringing up "state of mind"..... he'll totally go for an insanity defense (I know, I watch Law & Order ! :) )

              BUT....I wonder if Jaycee would defend her? As screwed up as that poor girl's got to be, she may say that Mrs. Garrido was good to her (ie: feeding her, perhaps not beating her, etc.).

              Sadder still, there's probably so many more stories like Jaycee's out there. Don't hundreds of kids go missing every day in this country?

                Yes, hundreds of kids suffer worse. Most of those kids die I think.

                17 years ago I called the cops because I saw two little boys in a store trying to catch my eye. They were clearly scared of the huge, fat man who had them by the hands. I will never forgive myself for not attacking the man, not being willing to go to prison to help them get away. The cops, when I called, refused to even send out a squad car. They flat refused. But hearing the Berkeley cops on the news say, "They looked at me with eyes that went through to your soul." has given me nightmares since. I saw those eyes and I didn't do enough.

                A few years ago I met a woman who was living in her car. It was quite odd, because most homeless people don't have a "straight vibe" if you know what I mean. She just seemed like a housewife who had something terrible happen to her. She was attractive, had a degree in chiropractic. (I confirmed as much of her story as I could, and everything I checked was true.) She told me that after she came home and found her son being sodomized for a movie that she ended up having to run for her life. She thinks it stopped, and her son grew up, but without her. She claimed that after she reported it to the cops in LA that there was no report in the system after the cop took one. And she said that threats happened, and the last straw was when she realized that a private investigator who had happened to get in touch with her and working pro bono was actually setting her up. She was nearly killed, and given a message to disappear forever or die. She was not allowed to see her son. She fled and lived under an assumed name for 15 years as a schoolteacher in another state. She said she was coming out of hiding and had contacted her son, who had been only told his mother had run away and was crazy. Of course, one cannot be sure, perhaps she was. But it all held together and I probed hard for inconsistencies.

                  First off, I mean no offense to you by this comment or to make you feel worse. My bio father abused me the first 16 years of my life. Nobody helped me until after I ran away from home at 16. One of my mom's friends asked me when I was 14 I think, if my dad was doing stuff to me. I hated that evil demon so much but because of how demented I knew he was, all of his threats, and what I knew he would do if I told...the only way I could communicate was to look at the ground and try and hold back the tears. She looked at me for a second and that was that. She never asked me again and never told my mom her suspicions. There was another incident where I was asked and again exhibited the same behavior. People need to open their eyes and listen to their intuition to stop this chain of torment. Not every look means the kid is abused, maybe those boys just got in trouble for breaking something, so don't blame yourself, you don't know. You did more than most people would have though by calling the cops. A lot has changed since then. But adults do need to start standing up and speaking out when we feel something is wrong. How can we expect a child to speak up and stand up for themselves, when the normal adult can not. Children pick up on behaviors, they see and sense that other adults do nothing, so they feel they can do nothing. But also, God has his course of action and you have to trust in God. As I already posted elsewhere, I hate my past but had it been different, then I would not have my husband and two precious children, those chain of events led to other chain of events. AS FOR THIS HOMELESS WOMAN--She is probably overcome with guilt right now. I can not imagine this woman! I would do anything to protect my kids, I have such maternal instinct it's not funny. Those bastards would be dead withing 5 seconds of me seeing that. And if I died in the process, so what! It is our jobs as parents to protect our kids, who cares about death threats! I have no sympathy for her what-so-ever. What another sorry excuse for a human being. "Oh, let me save myself and leave my poor defenseless child to suffer horribly because I'm a self absorbed, dreadful excuse for a waste of life and space on this earth." She is a horrible story, though I am glad to hear her son is ok today, and I know I shouldn't judge people, but any decent parent would die for their children.

                          My offender had a court appointed lawyer. I found out after the trial from my DA that he had tried to get removed from the case because he didn't believe him. Before and during the trial, I had harsh feeling toward his lawyer, but he only asked me 3 stupid questions during cross examination...and I know for a fact that my bio father (offender) was the one that wanted those questions asked. Lawyers have to do stuff sometimes that they may feel is morally wrong, but it's their job. Some are good, and some are just scumbags. All we can do is pray for the most important things here: that they are never allowed out of jail, and that Jaycee and her girls find peace and comfort and heal.

                                                Larry - read a few posts back, unfortunately it is a necessary evil to have defense attorney's and prosecutors. That is the way our legal system works. They would be let go on technicalities if they were not provided proper presentation. Being a defense attorney means sometimes you defend guilty people and sometimes you defend innocent people. As blatantly guilty as they are and as much as I and probably the rest of the world would like to see them castrated, shot, etc., etc, under OUR legal system. They are unfortunately entitled to a day in court.

What this story forgot to mention is that the girls thought that Jaycee was their older sister. This is what they told the U.C. police and what Mr Probyn confirmed a couple of days ago in a CBS interview. No matter what Mrs Garrido feels, this "family" was thoroughly twisted. IMHO, getting the basic facts in order up front is important because I would think any "healing" without that being done would be very fragile indeed.
