Your Career: A lesson for workplace lovers

— When talk show host David Letterman went public last week with the revelation that he had affairs with women who worked for him, he pointedly said he hopes “to protect my job.”

For the late-night comedian, that is no joke.

Many companies have policies that restrict or prohibit relationships between a boss and his or her subordinates, and violations can be career killers.

In 2005, to take one high-profile example, Harry Stonecipher was asked to resign from his post as chief executive officer of Boeing Co. when his extramarital affair with another executive at the company was exposed.

In the case of Sen. John Ensign, R-Nev., the damage is still unfolding from an affair he had with a member of his campaign staff (who also was the wife of a close aide) that was disclosed in June. In another case Fox News personality Bill O'Reilly settled a harassment lawsuit brought by a producer who said the two had phone-sex conversations.

In the O'Reilly case, the producer claimed she allowed the conversations to continue because he was her boss. "I'm not used to saying no to this man on any level," she said in one interview.

That is exactly why such relationships are frowned on in the workplace and why organizations establish guidelines for such liaisons, especially when they involve a head honcho and subordinates. Such relationships can lead to sexual favoritism, a hostile work environment and straight out sexual harassment.

“When you have a boss and subordinate relationship, one person has power over the other,” said Linda Henman, the author of “The Magnetic Boss.” “Whether that person abuses the power is irrelevant, the perception is there.”

Letterman technically is an employee of his Worldwide Pants production company, but CBS has a clear policy on the situation, and CBS suppliers are supposed to follow the broadcaster's policies.

Here’s a section of CBS’ 2008 Business Conduct Statement: “If a consenting romantic or sexual relationship between a supervisor and a direct or indirect subordinate should develop, CBS requires the supervisor to disclose this information to his or her Company’s Human Resources Department to ensure that there are no issues of actual or apparent favoritism, conflict of interest, sexual harassment, or any other negative impact on others in the work environment.”

It is not known whether Letterman informed anyone at the company about his affairs. CBS Television spokesman Chris Ender would not comment on the issue beyond this: “Mr. Letterman addressed the issue during the show’s broadcast (Thursday) evening, and we believe his comments speak for themselves.”

Romantic relationships in the workplace are nothing new. About 40 percent of workers have  had a workplace romance, according to a study by recruiting firm Spherion Corp. last year.

Such affairs can cause messy situations in the workplace, especially when they involve a boss and a subordinate, because they are seldom kept under wraps, said Henman. “People think they are cleverly hiding it but don’t recognize they a lot of people probably know,” she said.

There are a variety of legal claims that can arise out of relationships between a subordinate and superior, said Jennifer Kearns, a partner with the law firm Duane Morris who specializes in employment law.

Kearns offered three types of claims:

Kearns pointed to a case involving a prison warden and consensual relationships he had with several of his subordinates. In a lawsuit, two former employees who did not have such affairs claimed the warden favored his lovers, creating a hostile work environment.

Such favoritism is not necessarily enough for a discrimination claim, said Ray Peeler, senior attorney advisor for the Equal Employment Opportunity Commission. “But if you have somebody who’s serially doing this with employees where it becomes an issue to get ahead with this supervisor then that’s clearly illegal," he said.

Widespread sexual favoritism, he explained, can create a hostile work environment, and if a jilted lover demotes a subordinate or otherwise adversely impacts their job, that’s considered retaliation. Both are illegal.

The cases the EEOC is more likely to see involve situations where a relationship has gone sour and the manager continue to pursue a person who is not interested. That is considered sexual harassment.

Aside from the legal issues, there is also social and emotional fallout to consider.

“Once the work intensity subsides, you might feel embarrassed that the excitement propelled you toward intimacy with a co-worker,” said LeslieBeth Wish, a psychologist who writes about relationships at LoveVictory.com.

“You might have to work with this person on another project, and now your emotional and intellectual energies for work are compromised. You must now deal with your discomfort, disappointment and embarrassment.”

No matter how Letterman’s situation plays out, it does open up the question of whether such relationships are ever a good idea in the workplace, especially after the talk show host was ensnared in a $2 million extortion plot. A CBS News producer has been arrested and charged with the scheme.

I did an informal poll on Twitter following Letterman’s mea culpa, asking how an employee on this famous man’s show could say no to advances from the big cheese?

Here’s a sampling of the answers I got:

Henman believes these types of relationships involving successful men and women and their underlings often come down to a power trip.

“Look at Clinton and Monica Lewinsky,” she said, referring to the former president, a frequent butt of Letterman's jokes. “You have a naïve young woman, and the leader of the free world is interested in her. That’s pretty much an aphrodisiac.”

“I’m not saying,” she added, “that that’s what happened in Letterman’s case. But he’s rich and famous and that’s attractive, and he can use his position to get women in bed.”

Bosses also need to be aware. I have a friend who was sleeping with our boss oh so many years ago. As it turned out, she was also my roommate. She played the guy like a fiddle and TOTALLY walked all over him. Got special favors and the like. Then, when she was done with him, she was done. But, oops. Forgot to tell him. And then got mad when he'd call or stop over.

So what did she do? Filed a complaint and got him fired. Was he guilty? Sure. But, there was no specific rule against it. (This was a LONG time ago, after all!) She was in a consensual relationship with him and he got the short end of the stick in the end. He was a decent guy and a good manager. I have NO idea where he is today. But I'm quite sure he never got himself into that mess again. (She did. Many more times . . )

Common sense only because society is so STUPID. If I were a boss, I wouldn't sleep with a co-worker. But not because of any neanderthal so-called 'morals' Mostly because people can't handle the difference between work and anything else. So here's the middle finger to office employee problems.

Thankfully, I work in a business where it isn't even possibly a problem.

    I don't care what Letterman did or did not do. HOW he scewered Sarah Palin's YOUNG daughter for doing what teenagers do. He SHOULD KNOW BETTER! He blames Sarah Palin for the mistake her daughter made...SHE'S a KID! So...Sarah tried to tell her daughter to ABSTAIN...kid didn't listen...what kids do? Yet, here is MR. LATENIGHT who has a wife and son, and even if this happened before he married...he was in a "committed relationship" with this woman for something like 11 YEARS???? So....there ya have it....he can trash a teenager, yet as an adult, do the very same thing. GAG! What goes around, comes around. DAVE eat crow!!!!!!!

    I slept with one of my temps one time. I'm too cheap to hire a full-time secretary, plus my wife doesn't like me to be around the same woman too much of the time out of any given day. BIG mistake! She was a lousy lay! Fella's just don't do it! The disappointment was unbearably difficult to overcome because her body was BANGIN' and then I had to worry about her telling my wife after I let her go. LOL

        FIRE him......the ONLY reason he isnt fired is because of politics. He laughed about it and made jokes while announcing the affairs!!!! He thinks its funny, using women like that for his own pleasure. he thinks its just a thing to do. FIRE him and hopefully the women will sue his pants of ( no pun intended). The network should fire him, he's worse than Dan Rather lying and making up stories, and he got fired. This man is a useless late night talk show host that thinks his s*** doesnt stink. He is the reason i dont watch late night talk. Just FIRE the man.

        Letterman isn't a hypocrite. He never got up there and said he was part of the morality police. What he is though is a comedian. Not a very good one, but a comedian all the same. If you people are looking to a comedian for morality guidance, then it's something wrong with YOU! Definitely not David Letterman. He is what I would expect him to be.

        I think that people need to put this into perspective a bit. First of all, he was not married when he had these relationships so it is kind of ridiculous to call them "affairs". Grown men date grown women and these grown up adults occasionally engage in a mutual adult sexual relationship. Yes, he did have a long-time girlfiend, however, they were not married so this is not in the catagory of an extramarital affair. And the reason his private and personal relationships came to light was than someone on the CBS network team decided to become a blackmailer. Letterman never has stated he did not date women, he has been a bachelor all these years in the public eye, he has never had any charges against him for seduction of a co-worker and who really cares who he dated and when. He is not an elected official, he is not living off our tax payor dime, he took no oath of office, he is a television celebrity, a comedian. Does that make it OK to cheat? Who knows...did he cheat or not during these times. What was the real relationship between him and his (then girlfriend) since they have only been married a few months. It really is not anyone's business. Do I think dating the boss, or any co-worker is a good idea? No, definately not and sure some companies have rules against it, but lets be grown up people here, it happens all the time. It doesn't make those people bad, if two consenting adults date and their relationship is between the two of them, who's business is it really???

          Lets all remember that Letterman was a single man when these affairs occurred. That does not make it right, but he is not an adulterer. We do not know the details and can only guess if he was the instigator. For all we know he may have had these women throw themselves at him, after all, he is a star. What would any healthy, single man do? The answer is obvious. I commend him for coming clean after the extortion attempt, I think he did the right thing going to the police and all. As far as CBS canning him I doubt that will happen, His ratings are probably up because of this! Ironic, isn't it?

            Generally a bad idea to strike up with the boss or even a co-worker. The old adage of "you dont Sh*t where you eat" applies, meaning, if the relationship goes South, the office suddely gets real chilly since you still come in every day, and will interfere with work getting done. Sometimes tough to resist though when people work so closely together.

            I think Letterman was correct in contacting his attorney and then the authorities. No one should be black mailed. Period.

            That said, I think Letterman will not survive the revelations that he had a sexual relationship with a number of the women that worked for him. It almost seems to become his assistant meant you interned on his office couch . . . sans clothes. Letterman violated these women, not to say that he didn't also demean his now wife but previously long-term live-in girlfriend. The women willing to have sex with him for the position of working as his assistant knew there was a girlfriend but did the girlfriend know Letterman could be bringing home STDs to here after his trysts with his assistants?

            It is unethical to have a boss to use sexual harassment in the workplace and I think there needs to be an in-depth investigation into the office dynamics, pressures, persuasion, appearance of sex as a requirement for the job.

            I hope Letterman can heal his marriage. If I was his mother I would be disgusted and embarrassed. His wife deserves better even if she was just his significant other at the time of the affairs. She was and is the mother of his beloved Harry. It is time for Letterman to wind down his career on Late Night (perhaps Leno wants to take over the spot ;-)) and retire to Montana. Letterman needs to look into his need to demoralize the women in his life by having girlfriends, mistresses, one-night stands and perhaps paid escorts that offer sex for the dollar. A sad ending to a career. Someday Harry will read the stories and I imagine his father will drop in his son's esteem. Was it worth it, Dave?

            I've always considered Letterman to be a bit off kilter, and usually watched Leno. Now that Leno is gone from late night I don't watch any of the rest. But I have to say Letterman is a buffoon for getting involved with subordinates, and any female employee who lured him into a relationship, if that was the case, should be fired. Letterman should lose his job also. CBS needs to enforce it's rules.

            If Letterman worked for any other large corporation, he would already be gone. Large companies have definite rules against what evidently he has done for quite some time. I would hope the rules would apply to everyone in this situation including those in the entertainment/government business.

            It is less than disingenuous to believe the women involved in these affairs did not feel some sort of pressure to 'sleep with the boss.' Bob Barker got skewed with accusations that he slept with the models on the Price is Right. In this case, working for a media company, one would even be more reticent to complain about the affair as being harassment because you would never have work in that industry again if you took down a star like Letterman. Letterman did knowingly create a hostile workplace which it appears he used for his romps. Never mind he got married in March of this year. It shows me that sexual harassment is very alive and well in the workplace. It may be that Mr. Letterman is just a cad who doesnt comprehend the meaning of being in a committed relationship and had consensual sex with the bevy of workers at this office who were only too willing to oblige. However, since God gave me gray matter called a brain, and supplanted the same with common sense, I highly doubt that this is the case.

            Letterman is toast. He was an idiot for having sex with his employees. That is rule #1 for avoiding sexual harassment lawsuits - bosses don't sleep with the employees. He knows that which is why he said he hopes he keeps his job. Ask any HR person in a real company. He'll be gone by the end of the month, if not sooner. CBS will let him stay until they find a replacement so they can keep the show going. But, as for Letterman, he is pretty much done with TV. Most networks won't touch him because they don't want the liability of more sexual harassment lawsuits. He killed his own career which is a shame because he is a pretty funny guy.

            Actually, none of the women need to prove that sex=keeping job in order for the sexual harassment complaints to be pursued. If male staffers or interns can show that they were denied advancement over female staffers or interns solely because of sexual relationships, then a stong case for harassment based on the quid pro quo standard exists. And if there are any female staffers who rebuffed his invitation to the upstairs of the Bed Sullivan Theater, and they were passed by on promotions, etc. in favor of the ladies willing to "paly ball", the case is even stronger.

                  Letterman is one of the leading people fighting for the cause of the liberal agenda. He is not funny at all. His ego is as big as his mouth. He thinks he is some kind of big shot that has teh power to make or break people. Letterman has become the real joke of his show.

They live in their mansions and and drive their expensive cars and have awards for themselves just about every month. Then they come out and tell us regular Americans how we should be running this country. When all that they have done is made it worse with their garbage coming out from them.

                    Letterman and teh rest of Hollywood do not know how we real Americans live day by day. they are to busy wrapped up in themselves and being idolized by idiots that know no betetr way of spending their time and money.

                    Wow.......while I certainly don't disagree with you that plenty of celebs are doing and saying lots of stupid, useless things, let's not forget about the fact that many of them are pumping millions of their own dollars into charities around the country and the planet every day. And loads of them do all kinds of positive things for the good of others. And don't forget.......many of them came from jobs like waiting tables or parking cars before they got to be rich and famous. Or think of Brad Pitt, who used to have a job dressing as a chicken outside of a fried chicken restaurant! So most of them have "been there" at one time or another. No one is perfect. Judge not lest ye be judged, friend, cause Karma will come back to bite ya!!!

                    On to Dave.....I think he will hang in there as long as we don't find out that any of this was forced. If this was all consensual, then who cares? They're all adults. Let them do what they want. And if any of those women LIES to try and save their own rep.....well, as I said......Karma will get you!! But if Dave forced any of the women, or promised them things for sexual favors, then he needs to receive due punishment.

                      Those millions they give away to charities. It is actually our money that provides these Hollywood celebs to be able to do this. Yes they do give to charities and that is a good thing to do. But on the other hand just look at the influence they have on America. The movies and tv shows they put out have been ruining the minds of Americans for decades. Hollywood contributes very little for thegood of America. With the millions they get paid that is the least they should do is give it away. They are way way over paid for what they do. Bottom line is that Hollywood does far worse then good for America.

                      So Philyboy, are you saying that only "conservatives" should be allowed to keep their paychecks and liberals should give all their money away? I often times have a moral challenge in wrapping my head around why somebody that is simply an entertainer can make such huge sums of money for producing so very little good for the whole of society, but I'm also an economist and can easily explain supply and demand theory. As an avowed capitalist, I feel that if they made the money, they can spend it any way they want to. There is a good book out that was written in the 50's by Ayn Rand called Atlas Shrugged. I recommend it for all capitalists. I note an air of jealously in your writing style by the way.

I cannot understand why people just cannot make themselves stick to the story. No matter what articles people comment on on Newsvine, it's going to ultimately be turned into a political sideshow.                         This article shows how prudish people are. I'm not denying the problem with relationships with co-workers. But I am saying they all stem from selfish behavior, and disrespect. Technically, work and play should be separate. But it only takes one or the other person to make it a terrible situation. Rules won't solve this problem because people can't have a relationship, or want a relationship, without reducing it to manipulation when they can't get what they want.

                        If someone had a relationship with a co-worker and it either ended friendly, or ended in a lifelong relationship, my hats off to you. Because there are too many A-Holes out there these days.

                        Prudish? This has nothing to do with prudish.  When managers and such sleep with their employees there really rarely is nothing good that will come from it.  The problem is how did it come about. Did the manager pressure the employee to have sex for fear of losing the job....did the employee come on to the manager to get better treatment or position (no pun intended!) either way in the end 90% of the time someone will leave the job. It will be a "he said, she said" situation.  The "managers" aren't always males either, but it usually is. Look at Letterman's wife now, she use to work for him, they were togather a long time, until she got pregnant and he finally married her. Women usually know exactly what they are doing!  Sleeping with co-workers is never a good thing.

                                  Let's give the guy the benefit of the doubt until proven guilty. He had sexual relationships with people he worked with BEFORE he was married. These were not extramarital affairs. Second, who's to say that he initiated it? I have seen firsthand on separate occasions whereby the woman started the relationship in an effort to curry favor or just plain ol' have some fun. It is almost ALWAYS assumed that the male boss is the one that innitiates the fling. Word gets out that the boss is easy to get in the sack and you might bolster your career by doing so and the cougars prowl out of the woodwork. Granted, this is more often the exception than the rule, but don't be so shortsighted as to think it doesn't happen. I can assure you, it very much does. There again, let's give him the benefit of the doubt until it's is proven otherwise.

                                        Well I guess he does have a targeted audience that only liberals would watch his awful show. After all these are the same people that believe MSNBC and other liberal news outlets actually report on the facts and truth.                                           Women have been actively seeking to give up the goodies to the guy with power and resources since the beginning of time. The cave man who was the best hunter, the leader of the tribe, the generals of the armies, the richest merchant, the rock star, the guy on Forbes list of wealthiest and on and on down through the ages. There is nothing naive or innocent about them, they know precisely what they are doing. As I am now old I look back over periods of my life when I was at the top of my professional game but still a rather frumpy guy and I chuckle as I recall there were some very attractive women giving me obvious signals of availability at the points in my life when I was on top of the world.
