Katie Holmes sues Star Magazine over cover

LOS ANGELES — Katie Holmes sued the publishers of Star Magazine on Tuesday, accusing them of libel over a magazine cover that insinuated she was a drug addict.

The actress filed the lawsuit against American Media Inc. in federal court in Los Angeles. She said a January cover that featured the headline "Katie DRUG SHOCKER!" was false and not supported by the actual story in the magazine.

The cover featured a disheveled picture of Holmes, and the story itself claimed she was "trapped in a cycle of addictive treatments," based on interviews with former Scientology members.

"Star Magazine's malicious claims about Katie are untrue, unethical and unlawful," Holmes' attorney, Bert Fields, wrote in a statement. "Not only do they cruelly defame Katie, they play a cheap trick on the public, making ridiculously false claims on the cover unsupported by anything inside."

The complaint also states the cover story implies that Holmes is looking to split from husband Tom Cruise, which the lawsuit states is untrue.

""Of all the fabricated stories that continue to be published about me, this instance is beyond the pale," Holmes said in a statement. "The publisher knew this outrageous story was false and printed it anyway to sell magazines."

Star Magazine is standing by its story and said in a statement that it raises significant concerns about Church of Scientology practices, including the use of e-meters, devices that practitioners believe detect mental trauma.

"Star fully stands behind the editorial integrity of what we have published concerning Ms. Holmes' controversial use of the Scientology 'e-meter,'" the statement reads. "The physical effect of the e-meter on its users is a matter of significant public concern and we plan to vigorously defend the suit filed by Ms. Holmes.

"Our attorneys look forward to deposing Ms. Holmes about her experiences with Scientology and the e-meter, and expect that the case will be promptly dismissed by the court," the statement said.

Holmes, who starred in the television series "Dawson's Creek" and numerous films, is seeking more than $50 million in damages.

Her lawsuit claims the damage from the case came from the number of people who saw the cover, but probably never picked up the magazine or read the story to find out the allegations weren't about illicit drugs.

"Tens of millions of people saw the false and startling assertions of (Holmes') drug addiction on Star Magazine's cover, which was intentionally designed to deceive the public, while viciously defaming the plaintiff," the lawsuit states.

Other stars have had difficulty with cases against tabloids. In February, a federal judge dismissed claims by David Beckham against In Touch magazine over claims he cheated on his wife with a prostitute. The judge cited the magazine's First Amendment privileges, and said Beckham's attorneys hadn't proved the tabloid published the story with malice. The soccer star's attorney has vowed to appeal.

Star is a worthless tabloid. I'm glad she sued them, they print dishonest exploitative trash and bring down the standard of journalism in the United States.

Star doesn't make money printing the truth, they make money by printing outrageous lies. I hope the judge throws the book at them.

You would have to be on drugs to be married to Tom Cruise and be a Scientologist.

I don't know if this is true about her or not, but I sure as heck feel very sorry for her.

^^ I honestly wish it was true.
I seriously wish she would dump Cruise and come back to the silver screen.
She's still such a beautifully hot woman and I miss her presence, out and about. The only good thing that came from she and Cruise was a bright, healhty baby. But Holmes, being this "suzy, home maker" when she's so much better than that, especially a better actor, is just plain wrong.

I wouldn't mind her down to earth lifestyle, if she just wasn't so "in Tom's shadow" and she being the hot actress film star that she is. I know for a fact, I'd happily be her house-husband. I wouldn't drown her light for nothing. I'd take care of her, and be a great stepdad.

I've dated some single moms (giggity gigity), and if it's one thing that I can do is be a stepdad. It's a piece of cake! It's being a Godfather, except you can do the mom! Instead of just pitch in with taking care of her child and keep a good relation just in case of a parental life ending. And since it's like being a Godfather instead of an actual father, because the boyfriend has no real say so in raising the child, you can always be number 1 pal! The only growing pains you experience are the ones that only mom allows! Is that great or what?!

So yeah, I miss Katie Holmes. I want that beautiful woman back! wah!

      She should be more concerned about being in a cult and giving her young daughter credit cards with no limit than some thinking she is on drugs.

      I'm not sure that giving her little one credit cards is a bad thing. Don't get me wrong, it would be concerning if she went into debt and stressed like an adult, but to teach money management to one who's families are already so rich. I'm not sure that it such a bad thing.

      Everything else I agree with, though. Those damned cults. Boo! >:(
      And those damned drugs. Boo-o-o! >:)

      And that stuid Tom Cruise, BOOOOOOO! Oh uh, excuse me. ;):)
