Did transit workers do enough in subway rape case?

A young woman who was attacked in full view of New York City subway clerks blames witnesses for doing little to help her. She sued the Metropolitan Transit Authority, and the judge ruled that the transit workers had no obligation to help her other than contacting police. Do you agree with the judge's decision? Should witnesses have done more? Share your thoughts.

I don't agree with the judge. The witnesses should have gotten on the intercom. They would want someone to help them. Maybe they will lear

        Wow, what a horrible story. And "Maria" is a better person than I, because I WOULD expect fellow human beings - who see I am being raped - to HELP ME. I would actually expect that.

        As human beings, they have a moral right to try. They didn't have to put themselves into danger, but yelling out to say that the cops are on their way could have prevented part or maybe all of the attack.             Well, it's good to know that there are people like you out there. Wizards that think that behavior like this should be expected and planned for. I'm sure when you walk out the door each day you expect to arrive home just fine, and you should. So should she.               My jaw dropped as I read the story. I agree 100 % with "Maria"...the MTA workers did not need to actually go out of their booth and put themselves in danger as well, the LEAST they could have done is get on the loud speaker and scare him away.

              I am so happy she is talking about it and letting other females know, it does help them as part of their recovery. Now, I am actually a bit scared about getting on the subway again, knowing that the workers will look at one getting harmed, and not do anything about it. Do they not have wives, daughters, mothers...?

              Dave Schulze - you are truely part of the problem if you want to sit there and say part of the blame goes to the victim. What kind of lame '80s thought is that that it is the victims fault because she was out at that time.

              Get something straight-regardless of the time or clothing-no one deserves to be raped. I can only hope that you realize the presidence that type of thinking will do to the legal system and rights of others.

              I'm guessing if someone broke into your house because you didn't have a 10' wall or a mote surrounding it then it is your fault as well and should be held accountable.

              I think someone should have helped.

              In any situation where a fellow human being is in trouble I think our first instinct should be to help. Those workers were cowards.

              But to Maria, in as much as we know that you have a right to travel whenever you want, self preservation should come first. Ask someone to meet you, so that you don't have to travel alone at night, or travel in groups, never take safety for granted.

              Self preservation cannot come first in NYC. It is against the law to carry non-lethal protection, such as pepper spray or mace.

              Really. That's interesting about nonlethal protection being illegal in New York. Why not just go buy a gun then, and learn how to use it? Problem solved.

              The bearing of arms is one of our Constitutional rights, set in place so we can defend ourselves and rise up against a corrupt regime. I think it was Ben Franklin who called the weapons "the people's liberty teeth."

              If someone is trying to rape, rob, or kill you, you have the right to defend yourself using deadly force.

              Perhaps if she had had a gun her attacker could have taken it away from her and perhaps used it on her and the bystanders. No doubt the bystanders would then have done something to save themselves( the cowardly wusses).

              If the transit authority think it is unsafe for a person to travel on their system at 2 in the morning then perhaps they need to shut down their service until it is safer. Better idea of course would be for them to employ more transit police.

              Why is it safer to travel at all hours in other first world countries and some other 3 world countries except here?

              There are third world countries where I doubt the attacker would have been alive or for that matter have been able to flee (if he could still walk when they are done with him) before the police showed up. LOL

              Come to think of it, it is hard to believe in this day and age in the USA that a crime of this type would have been actively witnessed and nothing was done by the bystanders to stop it.

              A weapon would not have helped her in that circumstance, but knowing a little self defense would have helped. If somebody bear hugs you, you can headbut them if their chin is in close proximity to your head. That will shake them up a bit.

              You can also take your foot and slide it as hard as you can down their shin bone and stomp on their foot. That is guaranteed to hurt.

              Going completely limp is a good trick too. An attacker won't expect that, and you will become dead weight, at which point if you're using your head when they drop you, you can think of something else to do to get away. You can't panic. You have to think.

                David, don't you dare blame Maria. Would you say the same if it was your mother, sister or daughter? Think about it. Those witnesses should have gotten on the intercom and kept calling police until they arrived. If the train had stopped and stayed there, maybe he would have ran away. The conductor didn't have to step in, just stop the train. How does he sleep at night? I am getting tired of hearing about rapists all over the world. It makes me sick. Because of people like that, I am constantly afraid for my children. I can't even go to the grocery store and not worry when they want to trail a few steps behind and look at a toy because something could happen there too. It has in my state. Get it? It's not Maria's fault or any other woman for that matter. Rapists need to be castrated and then locked up for life. If the government would have harsher laws maybe women and their children could rest easier and this crazy world could start to become a better place. We all need to help make that happen.

                  It's a worse day in America when people think judges should rule however they see fit instead of law.                   That's an awful story. The law, training or rules are irrelevant. It's being moral, human and upstanding. Like poor Maria said - they didn't have to put themselves in harms way.                   I only wish she was able to NAME both of the MTA jacka$$es. I think they should be publically recognized for their wonderful actions. Forget what the judge said - if their names were PUBLIC, then the PUBLIC could openly "congradulate" them for being such heros. And of course I am sure the MTA would love to continue employees who get that much attention. Sometimes the court of public opinion works - WHO WERE THESE GUYS?

                  This tragedy shows the "it's all about me" mentality that is becoming more and more common in this country. I know that the majority of people encountered have morals and ethics and know right from wrong, but there are fewer and fewer that will actually stand up for that. To stand by and watch anyone harm another human being is insane. Watching and allowing another to commit a crime without taking any steps to prevent it should be punishable by law.

                        Rape is a terrible disgusting issue. BUT, she has clearly been coached by her Psychologist and Lawyer to seek Vindictive Justice. She forgives Rapist, but not MTA....clearly Vindictive.

                        MTA did their job, and her Lawyer is just looking for a big settlement to pocket and put blame on workers doind their job.

                        Obviously, only fire fighters are allowed to go in and fight fires, not civilians.

                        OMFG!!! how can you say stuff like that? Maybe Firefighters are the only ones allowed to fight fires, but that doesnt mean that bystanders cant try to help people before the firefighters get there. This is not about money, or a lawsuit, this is about the lack of human decency. The rapist more than likely has mental issues, but what is the workers excuse? Lack of Caring, thats it. Also, you can't make the statement that MTA did their job. They are responible for providing a SAFE, reliable means of transportation using TAX money. Every Station should have a security guard 24/7, that is just common sense.

                        No one is saying bystander can't help, or shouldn't help. What this is about is this woman and her lawyers want people to be REQUIRED to help. What do you think about a law requiring you to run into a burning building, or dive into icy waters to help someone drowning? Should you be obligated by law to help others and put your life in danger? This woman didn't sue becaue the MTA's transit system didn't have the propper measures in place, she sued because she felt the employees didn't do enough to help her. They hit the panic button and alerted authorities! What more should be required? How do you forgive an attacker and not the people that called for help? Oh yea, they didn't find the attacker, she can't sue him. But the MTA has money... No good deed goes unpunished and they should not be forgiven until they pay for thier deed.

                        More than they were capable or allowed to do. Laws must be changed to allow people to interfere somehow without threat of being sued. Somehow our system has been twisted to where people feel they are not allowed to do more than call the police.

                        Isn't there such a thing as the 'good samaritan act or law? If so wouldn't it apply so that the person who provides help cannot be sued?

                        Oh well, we have a law for everything else why not this? But then again, people break laws all the time so why bother?

                        Perhaps these bystanders were just wusses or the usual mindless drones one finds every where, who no matter what will not be helpful, and whose mantra is ' I was only doing my job'.

                        If the young woman had run on to the platform without paying for her ticket they would have tackled her and have her arrested for not paying her fare.....LOL Being raped on the other hand ...... oh well that is just in a days people watching. LOL

                        Perhaps they thought she was a prostitute who was engaging in rough sex, but called it in just to be on the safe side anyway, while doing nothing else to check if this was so.....

                        Wonder if these guys know about karma? What goes round comes around......

                        Again, would you consider it vindictive justice if it were you laying there being beaten or raped while others looked on, doing the bare minimum required by their job to help, rather than doing the RIGHT thing, helping a fellow human being?  What she wants, and what should happen, is a realization that someone stood there and did BARELY anything while she was violated in one of the most horrible ways possible in a PUBLIC PLACE.  People need to realize the consequences of inaction as much as the consequences of action. 

                        Sky-Boogy, I would like to see how vindictive you may be on your own behalf and without the coaching of an attorney if you were violated. Unfortunately, some people need to be on the receiving end of these things to understand the horror of it and I wouldn't wish that on anyone.

                        There ARE good samaritan laws that say you cant be sued for helping. That is a WORLD of difference from FORCING people to help! I think some of you have no clue of the implications of what you are asking for. This is not about being sued if you help and something goes wrong, this is about being sued if someone doesn't think YOU did enough to help. It is absolutely pathetic that a woman who got raped would SUE THE PEOPLE WHO CALLED POLICE!

                        Those 2 "men" , the one behind the booth and the one in the train, that saw this happening and did nothing but push a button should be ashamed of themselves. I am a short/small female and if I saw it happening, and I was all alone, my instincts would have kicked in and i would have IMMEDIATELY went after him like a wild angry animal, grabbing his hair, poking his eyes, kicking, whatever it took. And it would have helped her to turn her fear into anger and now he would have 2 angry women after him. I could not sit by and watch such horrific act going on, turn my back and just push a button and hide. I could NEVER be married to such wimps. No hero in this story, except the woman that came forward, to help other women.

                          I, a healthy male, would NOT be out at 2:00 AM alone. It is setting yourself up for trouble. No one deserves to be hurt but we have to be realistic. What type of people are on the streets at 2:00 AM.

                          I hope the two transit people, or their family, will have an opportunity to need help and no one comes to their rescue.

                            People like me - I am in the medical field, when you go to the emergency room in the middle of the night, you expect me (us) to be there to help you! Because of staff shortages, often have to stay over on PM shift & head home in wee hours. Shame on me for being there to care for you at such an unreasonable hour!

I know for one that its hard to talk about being raped because I had a family member who was and I believe for one that she is doing the right thing.
